Considerations Before Buying A Land For Your Farm Home

    By Corey Tyner

    Updated Jun 17

Here are the top things to think about before you make an offer on any land... How Much Property Do You NeedHow large will you want your home to be, and how much land do you want to surround it? What Repairs Does the Property Need?Even if there's no building on the property yet, the land itself may need work... Is there a lake or river that touches the property? Is it near the wetlands or marshes? Consider how much work each plot of property will need: and if you'll be capable of doing it...

1031 Exchanges and Farm Land: 5 Things that Landowners Need to Know

    By Tyler Davis

    Published Aug 2, 2019

Farmland, vacant land, and certain agriculture assets are considered real estate assets under the Internal Revenue Code. As much, farmers and others are able to utilize Internal Revenue Code (IRC) Section 1031 in order to defer tax upon the disposition of farmland and acquisition of a “like-kind” piece of property... I have identified five items that all farmers and agriculture business owners should know, as follows:#1 – You’re allowed to do a 1031 Exchange on your Farmland Should you wish to sell your existing farm land and buy like kind property, this exchange should qualify for tax deferred treatment, meaning you don’t have to pay the tax currently. When exchanging land for another real estate property only, the rules are fairly straight forward. Real property farmland is still allowed to be included in a 1031 Like Kind Exchange...

Tax Planning for Farmers Considering Selling their Land or Business

    By Tyler Davis

    Published Feb 12, 2020

The tax consequences of selling a farm or agribusiness should be at the top of the mind of every landowner... Even though putting the farm up for sale makes logical sense in most situations, farmers often have an emotional connection to their land and business that exceeds that of other industries... The first question farmers generally ask when selling their land or business is “How much do I owe Uncle Sam?” The answer to that question is “it depends... In most transactions, the sale of the land will create either a capital gain or capital loss... Second, farm owners should receive both a land appraisal and a business valuation before entering into negotiations with a buyer...

The Simple Business Lesson that Farmland Partners Can Teach Us

    By The Crossover

    Published Jul 14, 2018

There’s a simple lesson to be learned from the recent Farmland Partner’s accusations that has nothing to do with ethics... Not for the purposes of picking on Farmland Partners but to get a good reminder of a simple business lesson that can lead to ruin if forgotten (as it often is)... If you live or farm in an area where Farmland Partners has purchased property in recent years, and you have an idea of what fair market value is in your area, then there’s a good chance that one of the major themes of the article was not news to you. The prices they have been paying for farmland in most cases was far higher than fair market value... Why did they overpay? One reason: they were buying large tracts of farmland nationwide at a clip unprecedented in modern times...

Delaware Statutory Trust – Implication to Landowners & Farmers

    By Tyler Davis

    Updated Sep 15, 2020

The Delaware Statutory Trusts (DST) is a newer investment vehicle that allows real estate property owners, including farmers and ag landowners, to purchase tenants in common ownership in passive investment properties... Rather than having to play landlord and collect rent each month from tenants, the DST is allowed to be the property manager and oversee property operations on behalf of the investors... For example, a specific DST might have a minimum investment of $50k and only invest in citrus groves in Florida or industrial development land in Texas... For further guidance on Internal Revenue Code Section 1031 exchanges and how they apply to land and agriculture, please read 1031 Exchanges: 5 Things That Landowners Need to Know... 1031 Exchanges can apply whether an investor owns a duplex in a bad neighborhood or the top ag land in the area...

21st Century American Ag: Sourcing Successors and Finding Farmland

    By Gregory Heilers

    Published Jul 26, 2018

farming population continues to mature, another alarming trend develops: in the last decade, farmland values have more than doubled. The USDA’s Economic Research found that average farm estate values, including land and buildings, “more than doubled, rising from $1,483 per acre in 2000 to $3,060 in 2015... The growing number of established farms having no heir apparent occurs just as numerous young, landless, would-be farmers face increasing land values... Can your farm spare a cabin while benefiting from a sweat equity deal? While access to American farmland is, in some ways, even more limited today than in generations past, there are still a number of reasons why now is a great time for young people to pursue a career in farming. On the other end of the experience, older farmers have options besides selling to developers, or leaving their land to children who will do similar...
