A 1031 Exchange is a tax-deferred swap program in which farmers and others in the agriculture industry can participate. Farmland, vacant land, and certain agriculture assets are considered real estate assets under the Internal Revenue Code. As much, farmers and others are able to utilize Internal Revenue Code (IRC) Section 1031 in order to defer tax upon the disposition of farmland and acquisition of a “like-kind” piece of property... IRC Section 1031 allows a taxpayer to defer (not avoid) capital gains taxes realized upon the disposition of a property if the taxpayer replaces the property with a “like-kind” asset of equal or higher value. In order for the taxpayer to defer taxes, they must identify the new property within forty-five days of the disposition closing date and close on the new “like-kind” property within 180 days of the disposition closing date...

While a sole proprietorship is simple to establish, the negatives are personal liability and additional employment taxes... LLCs are very flexible in how they allocate income to partners and in how they report and pay income taxes... Depreciation of Replacement PropertyWhen a taxpayer receives compensation in excess of their basis in the property which has been stolen or destroyed, they can defer taxes by reinvesting the proceeds into a replacement property... The tax consequences of selling a farm or agribusiness should be at the top of the mind of every landowner... For the portion of the sale related to real estate and land, a farmer is allowed to do a Section 1031 exchange to defer paying taxes. Section 1031 allows a taxpayer to reinvest all of the proceeds in one or many properties and defer paying taxes on the gain... So, if you are an older farmer, a 1031 exchange can eliminate taxes on the sale of your farm if you reinvest the proceeds and hold the property until death. Additionally, taxpayers who inherit the property would also not have to pay taxes on the property involved in the 1031 exchange...

When a business purchases assets, the business entity is allowed to write off the value of the asset purchased over the life of the asset. Land, however, is not depreciable as the value of the dirt & minerals does not decrease over time like the value of structures, barns, fences, etc... One of the main questions taxpayers ask after a major purchase is “how much can I write off for taxes?” The answer can be very simple – usually, farm buildings are depreciated over 20 years... Part I, published on AgFuse in November of 2019, focused on planning opportunities for farmers with higher than expected earnings in 2019 while Part II focuses on tax planning opportunities for farmers with lower than expected current year performance. Farmers tend to think that tax planning opportunities are only available in high-income years or when they close on a big transaction (selling your property, selling a large amount of stock for a capital gain, etc). However, just as tax planning is essential in those situations, it is also critical to consider tax planning strategies during a down year...
